Our commitment to your privacy
Perry D. Passaro, Ph.D., A Psychological Corporation ("the Practice") is required by the Health Insurance Portability and Accountability Act (HIPAA) and California law to maintain the privacy of your protected health information (PHI), to provide you with this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect.
Uses and disclosures of PHI
For treatment. We may use and disclose your PHI to provide, coordinate, and manage your care. For example, we may share information with your psychiatrist, primary care physician, or other healthcare providers involved in your care.
For payment. We may use and disclose your PHI so that the services you receive may be billed to, and payment collected from, you, your insurance company, or a third party.
For healthcare operations. We may use and disclose your PHI for routine practice activities such as quality assessment, clinical supervision (including the supervision of associate clinicians), training, scheduling, and business management.
Other uses requiring your authorization. Most uses and disclosures of psychotherapy notes, uses and disclosures for marketing purposes, and disclosures that constitute a sale of PHI require your written authorization. You may revoke any authorization at any time, in writing, except to the extent we have already acted in reliance upon it.
Uses and disclosures permitted or required by law without your authorization. We may use or disclose PHI without your authorization in limited circumstances, including: when required by law; for public health activities; to report suspected abuse, neglect, or domestic violence; for health oversight activities; in response to a court order, subpoena, or other lawful process; to coroners, medical examiners, and funeral directors; for organ donation; for research that has been approved by an institutional review board; to avert a serious threat to health or safety; for specialized government functions (such as military or national security); for workers' compensation; and as otherwise required by law.
Your rights regarding your PHI
Right to inspect and copy. You have the right to inspect and obtain a copy of your PHI in our designated record set, with certain limited exceptions (notably psychotherapy notes). Requests must be made in writing. We may charge a reasonable, cost-based fee.
Right to amend. If you believe information in your record is incorrect or incomplete, you may request an amendment. We may deny your request in certain cases, but you have the right to file a statement of disagreement.
Right to an accounting of disclosures. You have the right to request a list of disclosures of your PHI made by us, with certain exceptions (such as disclosures for treatment, payment, or healthcare operations).
Right to request restrictions. You have the right to request a restriction on certain uses or disclosures of your PHI. We are not required to agree to a requested restriction except in the case of disclosures to a health plan for services you have paid for in full out of pocket.
Right to request confidential communications. You have the right to request that we communicate with you by alternative means or at an alternative location (for example, by mail at a P.O. box rather than by phone at home).
Right to a paper copy of this notice. You have the right to receive a paper copy of this notice upon request, even if you have agreed to receive it electronically.
Right to be notified of a breach. You have the right to be notified following a breach of your unsecured PHI.
How to exercise your rights or file a complaint
To exercise any of the rights above, please submit a written request to the Practice at the address below. If you believe your privacy rights have been violated, you may file a complaint with us using the contact information below, or with the Secretary of the U.S. Department of Health and Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint.
Changes to this notice
We reserve the right to change the terms of this notice and to make the new notice provisions effective for all PHI we maintain. We will post the revised notice on this website and make paper copies available in the office upon request.
